Choice of maritime law in Panama

The Maritime Procedural Code establishes conflict rules to determine the applicable substantive law.

In contracts with choice of law clauses, Panamanian courts will apply that law to the merits of the case, but the procedure will be governed by Panamanian law.

Forum selection clauses require proof of prior and express negotiation; otherwise, the courts retain jurisdiction.
